Owens, Clary & Aiken, L.L.P. represents management in all aspects of personnel and labor relations matter. Firm members are experienced in handling complex and challenging proceedings before administrative agencies and state and federal courts. Due to client needs, the Firm has established a national practice, having represented clients in numerous proceedings and legal disputes in states other then Texas. The Firm has undertaken the following:
- » Represented private and public employers in the investigation of charges and litigation of claims involving alleged violations of state and federal laws which prohibit discrimination on the basis of age, sex, national origin, religion, disability, and veteran status.
- » Represented private and public employers in actions alleging wrongful discharge, workers' compensation retaliation, breach of employment contracts and employment torts, such as claims of negligent and intentional infliction of emotion distress, invasion of privacy, slander and other defamation claims.
- » Advised clients on compliance issues arising from the Americans With Disabilities Act, performed employment application and handbook audits to ensure employer compliance with this Act.
- » Drafted policies and advised clients in regard to compliance with this recently enacted legislation.
- » Assisted clients in Fair Labor Standards Acts compliance involving matters such as minimum wage, overtime, home worker requirements and issue relating to the executive, professional and administrative exemptions from overtime requirements, as well as defended against charges and litigation alleging violations of the Fair Labor Standards Act.
- » Designed and implemented drug testing policies for compliance with Department of Transportation requirements, Drug Free Work Place Act, and Texas Workers' Compensation Act. Also designed drug policies for companies opting to test on a non-mandatory basis.
Advised clients on the regulations relating to polygraph testing and the procedures necessary to comply with those regulations.
